A National Firearms Act or NFA firearm, refers to a category of regulated firearms and other devices including machine guns, short-barreled rifles and shotguns, suppressors (silencers), and destructive devices. 

The sale of suppressors (silencers) and other NFA items listed above, as regulated under the National Firearms Act (NFA), requires that purchasers be at least 21 years of age and obtain a special tax stamp via an application process to legally own and operate these devices. 

The procedure consists of filing an ATF Form 4, Application for Tax Paid Transfer and Registration of Firearm (ATF Form 5320.4).  You must submit scans of your fingerprints and a photo with the ATF Form 4 when filing the form as an individual.  You may also choose to file the Form 4 under a Gun Trust, however all members of the trust will be required to submit fingerprints and photos. 

The Form 4, fingerprints and photo(s) are submitted to the ATF along with a fee of $200 for the tax stamp.   The approval process consists of passing the background checks and age requirements.  Once approved, the NFA item can legally be transferred to you via a Form 4473 process by your FFL.

If you purchase your NFA item from RIFLECRAFTERS,  no fee is charged to you by RIFLECRAFTERS to apply for your tax stamp or to transfer the item to you once your application is approved.

If you purchase the NFA item from another vendor and would like to use RIFLECRAFTERS transfer service to take possession of the item, the fee for an individual eForm 4 filing, fingerprinting and photo is $75.00 per NFA item.   If you are using a GUN TRUST to transfer the item, the fee is $150.00 per NFA item. 

The Government Tax stamp charge of $200 applies for all NFA items.

Applying for an NFA Tax Stamp using a Trust 

You will need to make the decision to file for a NFA tax stamp as an “Individual” or a “Trust” at the time of the sale and tax stamp application process.  If you choose to file as a Trust, the following procedures are required.

First, the legal paperwork to create a gun trust must be completed usually by an attorney or purchased from one of the vendors offering gun trust services.  You will need to submit a digital copy of the trust along with any notarized certification pages and amendments with your NFA application.  

All responsible parties mentioned in the trust must be identified and all responsible parties will be required to submit photos and fingerprints for background checks to be conducted at the time of NFA purchase and submitting of the eForm 4 to the ATF.  

All "responsible persons" listed in the trust will need to have an ATF eForms account. However, only the primary applicant (the person initiating the eForm 4) will typically use their PIN for the final submission/certification of the eForm 4 itself. 

All responsible parties mentioned in the trust are required to complete and submit ATF Form 5320.23, which is the “responsible person questionnaire.” 

Also, copies of ATF Form 5320.23 the “responsible person” form and the NFA application must be forwarded to the Chief Law Enforcement Officer (CLEO) in the locality in which the transferee is located for every “responsible person.”
